Travel Planning Agreement & Terms of Service

Travel is more than simply reaching a destination—it's an opportunity to create meaningful memories, strengthen relationships, celebrate milestones, and experience the world in ways that are uniquely personal. At Everwyn Travel, we believe exceptional vacations begin with thoughtful planning, honest guidance, and a trusted partnership between you and your Travel Advisor.

This Travel Planning Agreement outlines the responsibilities of both Everwyn Travel and our Travelers so that expectations are clear from the very beginning. Our goal is to provide a seamless planning experience while helping you make informed decisions throughout your journey.

Please read this Agreement carefully before authorizing Everwyn Travel to begin planning or booking your travel arrangements.

When you choose to work with Everwyn Travel, we are committed to:

Thoughtful Planning

We take the time to understand what matters most to you before making recommendations. Every itinerary is thoughtfully designed with your family's preferences, travel style, budget, and individual needs in mind.

Honest Guidance

Our recommendations are based on professional experience and what we genuinely believe will provide the best overall travel experience—not simply what is easiest to book.

Clear Communication

We strive to provide timely communication, transparent pricing information, realistic expectations, and guidance throughout every stage of the planning process.

Advocacy

If challenges arise before or during your travels, we will gladly work with travel suppliers on your behalf whenever possible. While many travel decisions ultimately remain under the control of airlines, hotels, cruise lines, tour operators, and other travel suppliers, we will always advocate for your interests and assist you in navigating unexpected situations.

Inclusive Travel

Creating accessible and inclusive travel experiences is one of Everwyn Travel's core values. We proudly welcome travelers of all abilities and are committed to helping every family feel prepared, supported, and confident throughout their vacation planning experience.

Our promise is simple:

We will approach every reservation with professionalism, integrity, compassion, and genuine care.

1. Acceptance of this Agreement

By requesting planning services, authorizing Everwyn Travel to obtain pricing or availability, paying a planning fee, authorizing a travel deposit or final payment, or otherwise engaging Everwyn Travel to provide travel planning or booking services, you acknowledge that you have read, understand, and agree to be bound by the terms of this Travel Planning Agreement & Terms of Service.

Throughout this Agreement, the terms Traveler, Client, and you refer collectively to the individual(s) traveling and any person accepting this Agreement on their behalf.

2. About Everwyn Travel

Everwyn Travel, LLC ("Everwyn Travel," "we," "our," or "us") is an independent travel agency that provides professional travel planning, consultation, reservation management, and vacation support services.

Our advisors work with a variety of third-party travel suppliers, including but not limited to airlines, cruise lines, hotels, resorts, tour operators, destination management companies, insurance providers, transportation companies, and entertainment providers.

Everwyn Travel acts solely as an intermediary between Travelers and these independent travel suppliers. We do not own, operate, control, or manage the travel services provided by these suppliers and therefore cannot guarantee their performance, policies, pricing, availability, or actions.

Travel arrangements booked through Everwyn Travel remain subject to the individual terms, conditions, rules, and policies established by each travel supplier.

3. Our Services

Every vacation is unique, and our planning services are designed to provide personalized guidance before, during, and, when appropriate, after your travels.

Depending on your destination and the services requested, Everwyn Travel may provide:

• Personalized vacation planning and destination recommendations.

• Resort, hotel, cruise, vacation package, and tour research.

• Flight, transportation, excursion, dining, and travel experience recommendations.

• Reservation management, including applicable modifications prior to travel.

• Guidance regarding travel documentation, supplier policies, payment schedules, and important deadlines.

• Accessibility planning and advocacy for travelers with disabilities or unique support needs.

• Coordination of special requests with travel suppliers whenever possible.

• Ongoing support before your departure and assistance with supplier-related issues during travel, when reasonably available.

The specific services provided may vary depending on your destination, travel supplier, reservation type, and whether a planning or professional service fee has been assessed.

Everwyn Travel reserves the right to determine which services are included as part of each reservation.

Nothing in this Agreement shall be interpreted as creating a guarantee that every requested service, accommodation, supplier, itinerary, reservation, or travel experience can be obtained.

4. Planning Fees & Professional Service Fees

Travel planning requires significant time, expertise, industry knowledge, and ongoing support. While many reservations do not require a planning fee, certain vacations involve extensive research, multiple revisions, complex itineraries, concierge-level planning, or ongoing consultation.

To fairly compensate our Travel Advisors for their professional time and expertise, Everwyn Travel and its independent Travel Advisors reserve the right to charge planning fees and other professional service fees.

These fees may include, but are not limited to:

• Vacation planning fees

• Complex itinerary planning fees

• Air-only booking fees

• Group planning fees

• Reservation modification fees

• Research and consultation fees

• Planning cancellation fees

• Other professional service fees as disclosed before services begin

Any applicable fee will always be discussed and disclosed before work begins.

Unless otherwise stated in writing, all planning fees and professional service fees paid directly to Everwyn Travel are non-refundable and non-transferable, regardless of whether travel is ultimately booked, modified, canceled by the Traveler, canceled by a supplier, or not completed for any reason.

Payment of a planning fee compensates Everwyn Travel for professional services rendered and is separate from any deposits, supplier payments, cancellation penalties, or travel insurance premiums.

5. Quotes, Pricing & Promotional Offers

Travel pricing is dynamic and subject to change at any time until a reservation has been confirmed with a deposit or full payment, as required by the travel supplier.

Quotes provided by Everwyn Travel are based upon pricing and availability at the time they are prepared and do not guarantee future pricing or availability.

Travel suppliers may increase or decrease pricing without notice based on factors including availability, occupancy, airfare fluctuations, demand, promotional inventory, currency exchange rates, fuel surcharges, taxes, and government-imposed fees.

Everwyn Travel cannot guarantee that previously quoted pricing will remain available until your reservation has been confirmed.

From time to time, travel suppliers may introduce new promotions, discounts, or special offers after a reservation has been booked. These promotional offers may not apply to existing reservations and are subject entirely to each supplier's policies. Everwyn Travel cannot guarantee that reservations can be repriced or modified to receive newly released promotions.

Because supplier pricing changes frequently, Everwyn Travel does not guarantee price matching after a reservation has been confirmed.

If pricing decreases before your reservation is finalized, your Travel Advisor will make reasonable efforts to obtain the lower rate whenever permitted by the travel supplier.

6. Deposits, Payments & Payment Authorization

Securing your travel arrangements often requires deposits and scheduled payments established by individual travel suppliers. Meeting these deadlines is one of the most important steps in protecting your reservation.

Travelers are solely responsible for ensuring all deposits and final payments are made on or before the deadlines established by the applicable travel supplier.

Failure to submit payment by the required deadline may result in:

• Automatic cancellation of your reservation

• Loss of promotional pricing

• Supplier-imposed cancellation penalties

• Forfeiture of deposits

• Rebooking at higher current pricing, if available

Everwyn Travel is not responsible for reservations canceled or modified due to missed payment deadlines.

Payment Authorization

By authorizing Everwyn Travel to process a payment or submit payment to a travel supplier on your behalf, you certify that you are an authorized user of the payment method provided and authorize the requested charges.

Travelers remain responsible for reviewing all payment amounts before authorizing payment.

Credit Card Security

Protecting your personal and financial information is important to us.

Whenever possible, Travelers will submit payment information directly through our secure Customer Relationship Management (CRM) system or through a secure payment system provided by the travel supplier.

Everwyn Travel does not encourage the transmission of complete credit card information through unsecured email or text message.

Payment information is collected, processed, and stored only as permitted through our secure payment platforms and applicable payment processing requirements.

Returned Payments & Chargebacks

Returned payments, declined transactions, reversed payments, or chargebacks may result in cancellation of travel reservations if supplier payment deadlines cannot be met.

If a Traveler initiates a credit card dispute or chargeback for services properly provided by Everwyn Travel, Everwyn Travel reserves the right to suspend further planning services while the dispute is being investigated.

Nothing in this Agreement limits Everwyn Travel's right to pursue collection of legitimately owed planning fees, professional service fees, supplier payments, or other authorized charges.

7. Reservation Changes & Cancellations

Travel plans sometimes change, and we'll always do our best to assist you. However, all reservation changes remain subject to the policies, availability, and fees established by each travel supplier.

Changes may include, but are not limited to:

• Travel dates

• Destinations

• Resorts or hotels

• Cruise sailings

• Flights

• Passenger names

• Room categories

• Cabin categories

• Transportation

• Excursions

• Special requests

Many travel suppliers charge change fees, cancellation penalties, or require reservations to be repriced at current market rates.

In addition to any supplier-imposed fees, Everwyn Travel and its independent Travel Advisors reserve the right to charge a professional service fee for significant reservation modifications when substantial additional planning time is required. Any applicable fee will be disclosed before work begins.

If a Traveler chooses to cancel a reservation, supplier cancellation penalties will apply according to the supplier's terms and conditions. Everwyn Travel has no authority to waive or refund supplier-imposed penalties.

Planning fees and professional service fees paid directly to Everwyn Travel remain non-refundable.

8. Communication Expectations

Exceptional travel planning is built on timely communication and collaboration between Travelers and their Travel Advisor.

Everwyn Travel conducts most client communication through email to ensure important travel information, confirmations, invoices, deadlines, and supplier communications are documented accurately.

Travelers are responsible for monitoring the email address provided to Everwyn Travel throughout the planning process and before departure.

While we strive to respond as promptly as possible during normal business operations, response times may vary based on advisor availability, weekends, holidays, travel schedules, and periods of increased client demand.

9. Reservation Review & Accuracy

Carefully reviewing your travel documents is one of the most important steps in ensuring a smooth travel experience. Promptly identifying errors allows corrections to be made before supplier deadlines or travel begins.

Travelers are responsible for reviewing all travel documents, confirmations, invoices, itineraries, and supplier communications immediately upon receipt.

Please carefully verify all reservation details, including but not limited to:

• Traveler names (exactly as they appear on government-issued identification)

• Dates of birth

• Travel dates

• Destinations

• Hotel or resort selections

• Room categories

• Cruise ship, sailing date, and cabin selection

• Flight information

• Transportation arrangements

• Excursions and activities

• Dining reservations

• Payment schedules

• Accessibility requests

• Special requests

• Pricing and reservation details

Travelers are encouraged to review all travel documents within seventy-two (72) hours of receipt and notify Everwyn Travel immediately of any errors, omissions, or discrepancies.

Everwyn Travel is not responsible for additional costs, supplier penalties, denied boarding, reservation modifications, loss of promotional pricing, or other expenses resulting from information provided incorrectly by the Traveler or errors that were not reported in a timely manner.

10. Travel Protection & Travel Insurance

Unexpected situations can arise before or during any vacation. Travel protection helps safeguard your financial investment and may provide valuable benefits should your travel plans unexpectedly change.

For this reason, Everwyn Travel strongly recommends that every Traveler purchase a comprehensive travel protection plan.

Travel protection may provide benefits for situations including, but not limited to:

• Trip cancellation

• Trip interruption

• Travel delays

• Missed connections

• Lost, stolen, or delayed baggage

• Emergency medical expenses

• Emergency medical evacuation

• Accidental death and dismemberment

• Supplier financial default (when applicable)

Coverage varies by policy, provider, destination, and individual circumstances. Travelers are responsible for reviewing the specific terms, conditions, exclusions, and limitations of any travel protection plan before purchasing coverage.

If a Traveler declines travel protection after it has been offered, Everwyn Travel shall not be responsible for any financial loss resulting from cancellations, supplier penalties, medical emergencies, weather events, travel disruptions, or other unforeseen circumstances that may have been covered under an applicable policy.

Everwyn Travel does not administer insurance claims and cannot guarantee claim approval. Questions regarding benefits, coverage, or claim determinations must be directed to the travel protection provider.

11. Travel Documents & Entry Requirements

Every Traveler is solely responsible for obtaining and carrying all required travel documentation for their itinerary.

Depending on your destination, required documentation may include:

• A valid passport

• Required visas

• REAL ID-compliant identification (when applicable)

• Birth certificates or other documentation for minors

• Vaccination or health documentation

• Customs or immigration forms

• Other documentation required by government authorities or travel suppliers

Travelers are responsible for ensuring that all required travel documents remain valid for the duration of their trip and satisfy the entry requirements of every destination visited.

Many countries require passports to remain valid for at least six (6) months beyond the date of return. It is the Traveler's responsibility to verify all passport validity requirements before departure.

Entry requirements, passport requirements, health requirements, and government regulations may change without notice. Travelers are responsible for verifying current requirements prior to departure.

Everwyn Travel is not responsible for denied boarding, denied entry, missed travel, additional expenses, or other losses resulting from incomplete, expired, inaccurate, or missing travel documentation.

Traveling with Children

Parents and guardians are responsible for ensuring that all minors traveling have the required documentation, identification, permissions, and legal authorization necessary for travel.

Travel requirements for minors vary by destination, airline, cruise line, and government authority. Everwyn Travel encourages Travelers to verify all applicable requirements well in advance of departure.

Pregnancy & Medical Considerations

Travel suppliers may establish restrictions regarding pregnancy, infants, medical conditions, mobility limitations, and fitness to travel.

Travelers are responsible for understanding and complying with all applicable supplier policies and should consult their healthcare provider before traveling if they have any medical concerns.

Everwyn Travel cannot waive or modify supplier medical policies.

12. Accessibility, Special Needs & Inclusive Travel Planning

At Everwyn Travel, we believe every traveler deserves the opportunity to explore the world with confidence.

Thoughtful accessibility planning is one of our core areas of expertise. We are committed to taking the time to understand each Traveler's unique needs and communicating requested accommodations to travel suppliers as accurately and thoroughly as possible.

Whether planning for autism, sensory sensitivities, mobility limitations, cognitive disabilities, chronic illnesses, hearing or vision impairments, dietary restrictions, medical conditions, or other accessibility needs, our goal is to help every Traveler make informed decisions and feel prepared for a successful travel experience.

We recognize that no two Travelers are alike. Every family, individual, and situation is unique, and we strive to provide personalized recommendations based on your specific travel goals, support needs, and comfort level.

While Everwyn Travel is happy to advocate on your behalf, Travelers acknowledge that accommodations and accessibility services are ultimately provided at the discretion of the applicable travel supplier.

Accessibility Planning May Include Assistance With

Depending on your destination and travel supplier, Everwyn Travel may assist with communicating requests or providing guidance regarding:

• Accessible hotel or resort rooms

• Wheelchair-accessible transportation

• Mobility equipment rentals

• Airport wheelchair assistance

• Accessible cruise accommodations

• Seating requests

• Dietary accommodations

• Food allergy notifications

• Refrigeration requests for medications

• Medical equipment accommodations

• CPAP machine guidance

• Service animal documentation guidance

• Autism and sensory-friendly planning

• Neurodivergent travel planning

• Cognitive disability accommodations

• Connecting or adjoining room requests

• Celebration requests

• Other supplier-supported accessibility accommodations

The specific services available vary by destination and supplier and may change without notice.

Supplier Accessibility Programs

Everwyn Travel is happy to educate Travelers regarding accessibility programs and accommodations offered by travel suppliers, including airlines, cruise lines, resorts, theme parks, attractions, and other travel providers.

These programs may include disability access services, accessibility passes, mobility assistance, priority boarding, sensory accommodations, accessible transportation, and other supplier-specific accessibility offerings.

Examples include, but are not limited to:

• Disney Disability Access Service (DAS)

• Universal Orlando's Attraction Assistance Pass (AAP)

• Airline wheelchair assistance

• Cruise accessibility accommodations

• Resort accessibility services

• Other supplier-sponsored accessibility programs

Eligibility, availability, and accommodations are determined solely by each travel supplier and remain subject to change without notice.

Everwyn Travel cannot guarantee approval, participation, availability, or specific accommodations under any supplier accessibility program and is not responsible for changes to supplier policies, procedures, eligibility requirements, or program availability.

Accommodation Requests

Everwyn Travel will gladly communicate accommodation requests to travel suppliers whenever possible.

However, Travelers acknowledge that accommodation requests are requests only unless specifically confirmed in writing by the applicable travel supplier.

Everwyn Travel cannot guarantee the availability of:

• Accessible guest rooms

• Specific room locations

• Connecting or adjoining rooms

• Airline seating assignments

• Wheelchair availability

• Disability accommodations

• Dietary accommodations

• Attraction accessibility

• Accessibility equipment

• Transportation accommodations

• Any other special accommodation controlled by a third-party supplier

Supplier policies, accommodations, and accessibility offerings may change without notice and remain outside the control of Everwyn Travel.

Medications & Medical Equipment

Travelers are solely responsible for ensuring they travel with all necessary medications, medical equipment, prescriptions, mobility devices, batteries, chargers, medical supplies, and supporting documentation required for their trip.

Travelers should consult with their healthcare provider regarding travel with medications or medical equipment and verify any applicable airline, cruise line, destination, or government requirements before departure.

Everwyn Travel is not responsible for delays, denied boarding, denied entry, confiscated medications or equipment, supplier restrictions, or other issues resulting from a Traveler's failure to comply with applicable travel requirements.

Traveler Responsibilities

To help us provide the most appropriate recommendations and communicate accurate requests to travel suppliers, Travelers agree to disclose any known accessibility needs as early as possible during the planning process.

This may include, but is not limited to:

• Mobility limitations

• Autism or other neurodevelopmental conditions

• Sensory sensitivities

• Cognitive disabilities

• Hearing or vision impairments

• Medical conditions

• Dietary restrictions or food allergies

• Medication storage requirements

• Medical equipment

• Service animals

• Other accessibility or support needs that may affect the travel experience

Failure to provide complete or accurate information may limit Everwyn Travel's ability to recommend appropriate travel options or communicate accommodation requests to suppliers.

Accessibility Information

Everwyn Travel relies on information provided by Travelers and third-party travel suppliers when making recommendations regarding accessibility.

While we make every reasonable effort to verify accessibility information, Travelers acknowledge that accessibility features, accommodations, transportation, attractions, guest rooms, facilities, policies, and supplier offerings may change without notice.

Everwyn Travel cannot independently verify every accessibility feature at every destination and is not responsible for inaccuracies, changes, or omissions in information provided by third-party travel suppliers.

13. Professional Recommendations

Everwyn Travel provides personalized recommendations based on professional experience, supplier knowledge, destination expertise, and the information provided by each Traveler.

Our recommendations are intended to help you select travel experiences that best align with your goals, budget, travel style, and any accessibility or support needs.

Travelers remain solely responsible for making all final decisions regarding their travel arrangements.

If a Traveler elects to proceed with travel arrangements that differ from Everwyn Travel's professional recommendations, Everwyn Travel shall not be responsible for dissatisfaction arising from those decisions, including but not limited to concerns related to accommodations, accessibility, resort selection, itinerary design, transportation, or overall travel experience.

14. Supplier Relationships & Third-Party Responsibility

Everwyn Travel acts solely as an intermediary between Travelers and independent travel suppliers. These suppliers may include, but are not limited to:

• Airlines

• Cruise lines

• Hotels and resorts

• Tour operators

• Transportation providers

• Theme parks and attractions

• Travel insurance providers

• Destination management companies

• Entertainment providers

• Independent excursion operators

All reservations remain subject to the terms, conditions, rules, policies, and contractual requirements established by the applicable travel supplier.

Travel suppliers retain sole responsibility for providing the travel services purchased. Everwyn Travel does not own, operate, manage, or control the services provided by any third-party supplier.

Travel suppliers may, at their sole discretion and without prior notice:

• Modify itineraries

• Change schedules

• Substitute accommodations

• Change pricing

• Renovate properties

• Close attractions or facilities

• Modify accessibility offerings

• Change entertainment or operating hours

• Cancel reservations

• Discontinue amenities or services

These decisions are outside the control of Everwyn Travel.

While Everwyn Travel will gladly assist Travelers in communicating with suppliers and advocating on their behalf whenever possible, Everwyn Travel cannot guarantee supplier decisions regarding refunds, compensation, upgrades, accessibility requests, schedule changes, availability, or other requested resolutions.

Everwyn Travel is not responsible for any act, omission, error, negligence, bankruptcy, financial default, delay, cancellation, injury, loss, damage, inconvenience, or other occurrence caused by any third-party travel supplier.

15. Pricing, Quotes & Promotional Offers

Travel pricing is dynamic and subject to change until a reservation has been confirmed and any required deposits have been received by the applicable travel supplier.

Unless otherwise stated in writing, all quotes are subject to:

• Availability

• Supplier inventory

• Promotional availability

• Currency fluctuations

• Fuel surcharges

• Government taxes and fees

• Supplier-imposed charges

Pricing cannot be guaranteed until a reservation has been confirmed by the travel supplier.

Travel suppliers may introduce new promotions, discounts, or special offers after a reservation has been confirmed.

Promotional offers that become available after booking may not be applicable to existing reservations and are subject to the individual supplier's policies.

If a Traveler requests that Everwyn Travel review a reservation for newly released promotions, Everwyn Travel will gladly do so whenever possible. However, supplier restrictions may prevent existing reservations from qualifying for new promotions without additional costs, penalties, or repricing.

16. Traveler Conduct & Right to Decline Service

Everwyn Travel is committed to providing a professional, respectful, and welcoming planning experience for every Traveler.

Travelers agree to communicate respectfully with Everwyn Travel, its employees, independent contractors, travel advisors, suppliers, and business partners throughout the planning process.

Everwyn Travel reserves the right to refuse or discontinue services at any time if a Traveler:

• Becomes abusive, threatening, discriminatory, or harassing

• Uses profanity or abusive language toward agency staff or suppliers

• Makes unreasonable or fraudulent demands

• Repeatedly disregards agency policies

• Refuses to meet payment obligations

• Engages in dishonest or deceptive conduct

• Creates an unsafe or hostile working environment

If services are discontinued, Travelers remain responsible for any planning fees, professional service fees, supplier penalties, cancellation fees, or other charges already incurred.

Nothing in this section limits Everwyn Travel's right to pursue any legal remedies available under applicable law.

17. Force Majeure

Everwyn Travel shall not be liable for any delay, interruption, cancellation, injury, loss, damage, additional expense, or failure to perform resulting from events beyond its reasonable control.

Such events include, but are not limited to:

• Severe weather

• Natural disasters

• Acts of God

• Pandemics or epidemics

• Government actions or travel advisories

• Civil unrest

• Terrorism

• Labor strikes

• Airline disruptions

• Transportation interruptions

• Supplier bankruptcy or financial default

• Utility failures

• Technology failures

• Mechanical failures

• Military actions

• Border closures

• Other unforeseen circumstances beyond Everwyn Travel's reasonable control

Travelers acknowledge that such events may result in delays, itinerary changes, supplier cancellations, additional expenses, or the complete cancellation of travel.

Everwyn Travel will make reasonable efforts to assist Travelers in working with suppliers during such events but cannot guarantee refunds, credits, alternate arrangements, or compensation.

18. Limitation of Liability

To the fullest extent permitted by law, Everwyn Travel shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to travel planning services or travel arrangements.

Everwyn Travel's liability, if any, shall be limited to the amount of planning fees or professional service fees actually paid directly to Everwyn Travel for the specific reservation giving rise to the claim.

Everwyn Travel shall not be liable for:

• Supplier errors or omissions

• Travel delays

• Missed connections

• Lost, stolen, or damaged baggage

• Changes to supplier services or amenities

• Personal injury

• Illness

• Death

• Emotional distress

• Loss of enjoyment

• Lost wages

• Lost business opportunities

• Acts or omissions of third-party suppliers

Nothing in this Agreement limits any rights that cannot legally be waived under applicable law.

19. Privacy & Data Security

Everwyn Travel respects your privacy and is committed to protecting the personal information you provide during the travel planning process.

Personal information collected may include names, contact information, dates of birth, passport information, emergency contacts, travel preferences, accessibility requests, and other information necessary to plan and manage your travel.

Payment information will be collected through secure payment methods whenever possible. Everwyn Travel encourages Travelers to submit payment information through our secure Customer Relationship Management (CRM) system or directly through approved supplier payment portals. Everwyn Travel does not encourage the transmission of complete credit card information through unsecured email or text message.

Personal information will be shared only as reasonably necessary to complete travel arrangements with travel suppliers, insurance providers, payment processors, or other travel-related partners.

While Everwyn Travel takes reasonable measures to protect your information, no electronic system can be guaranteed completely secure. By utilizing Everwyn Travel's services, Travelers acknowledge and accept the inherent risks associated with electronic communication and data transmission.

20. Acceptance of Terms & Conditions

By submitting payment, signing this Agreement electronically or in writing, or authorizing Everwyn Travel to make travel reservations on your behalf, Travelers acknowledge that they have read, understand, and agree to these Terms & Conditions.

These Terms & Conditions constitute the entire agreement between the Traveler and Everwyn Travel regarding travel planning services unless otherwise agreed to in writing.

If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Iowa, without regard to its conflict of law principles. Any dispute arising from these Terms & Conditions or Everwyn Travel's services shall be brought exclusively in the state or federal courts located in Polk County, Iowa.
